Terms of Service

1. Structure of the Services

Digital Action Software Services LLC provides two main lines of technological activity:

• Business Line: Consulting, custom software development, process automation, and development of portals and business applications for small and medium-sized enterprises.
• Video Game Line (DA Quizs and Games): Development, publishing and maintenance of entertainment and interactive trivia applications for mobile devices.

2. Contracting of Software Services for SMEs

For the contracting of bespoke development services:

• Quotations and Proposals: Every commercial proposal shall be valid for 30 calendar days from its issuance unless a different period is expressly stipulated.
• Scope Agreement: Every project shall formally commence upon the signing of the corresponding services agreement and the approval of the technical requirements specification.
• Intellectual Property and Source Code: Unless otherwise duly formalised by agreement, upon full settlement of the agreed fees, the Client shall acquire exclusive ownership of the source code developed specifically for its organisation.
• Software Warranty: A minimum warranty period of 30 calendar days following delivery into production is established to remedy, at no cost, programming defects or deviations from the approved specifications.

3. Mobile Video Game Licence of Use (EULA)

With respect to the games published by our DA Quizs and Games division (including Imperium Trivia and FTT Quiz):

• Grant of Licence: We grant the User a personal, non-exclusive, non-transferable, revocable and limited licence to download, install and use the game for personal, non-commercial entertainment purposes.
• Fair Play Rules: The use of emulators with automated scripts, auto-answer bots, reverse engineering of the APK package or any attempt to artificially manipulate the world leaderboards is strictly prohibited. We reserve the right to block any infringing user temporarily or permanently.
• Virtual Items and Achievements: Virtual coins, medals, titles or unlockable items within the games have no real monetary value, are neither refundable nor redeemable for money, and do not constitute transferable property of the User outside the game environment.

4. User Accounts and Security

Where an application or portal requires the creation of a user account, the User shall be solely responsible for safeguarding the confidentiality of their access credentials and for any activity carried out from their account. They must immediately report any unauthorised use or security breach.

5. Payments and Refunds

Purchases made within our mobile applications through the official Google Play Store are subject to the billing and refund policies of Google Play. For refund requests relating to in-app purchases, the User may turn to the Google Play help centre or write to our support channel at info@digitalaccion.com.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Digital Action Software Services LLC shall not be liable for indirect, incidental, special or consequential damages arising from the use of, or the inability to use, our applications, or from the temporary interruption of online services due to maintenance or force majeure.

7. Modification of the Terms

We reserve the right to modify these terms at any time. Substantial changes will be notified by means of their visible publication on this website or through updates in the mobile applications. Continued use after the publication of the modifications shall constitute acceptance of the new terms.
